According to the Saudi Labor Law, each and every expat has to get the right Annual Leave. But some it happens that the employer is not giving the annual leave to the employees. Therefore many reasons, but one of the main reason is unawareness of the rules related to Annual leave in KSA under Labor

Annual Leave Under Saudi Labor Law

The expatriates employees working in KSA are allowed by the Saudi Labor Law to have paid annual vacation of Twenty-One (21) days.

By requesting of the employee to their employer if the contract is less than 21 days to increase up to Twenty-One days.

Employee Entitled For 30 Days

If One of the workers is working with same Kafeel since five years, then he is entitled to one month paid annual leave. IF your sponsor is not following this rules, He is offending violating Saudi Labor Law under Article no (109.1).

Annual Vacation After 2 Years

Under the Saudi Labor Law after completing two years of a job with your current employer can apply for leave. Each and every expat worker in KSA should aware for vacation leave during the term of it is due.

If the expat worker does not do so, Its company decided to give him Leaves for the future year or forfeit the advantage.

Sick Leave Under Saudi Labor Law

Under the Saudi Labor if worker whose sickness has been proven is allowed to take 120 days sick leave from employer (company). In this condition the company unable to terminate an employee from the job or payroll. The employee has to proof by the certification of the doctor stating the number of days needs to rest. Without the sick leave of specialist/doctor medical certificate, It is the discretion of the sponsor. It is allowed to the worker to add his annual leave with the Sick leaves.

Full, Half, Unpaid Leave

Yearly Implemented necessary quota of Leave is as follow,
First thirty days, full Paid
Next sixty days, 3/4 of Total Wages
Next thirty days, without pay

Death In the Family Leave Under Saudi Labor Law

According to the Saudi Labor Law Article No. 160, In the case of mortality of Brother or Sister, Father or Mother, and Wife the employee is entitled to five days paid leave as per the new amendments to Saudi Labor Law of 2015. It was three days before. For the Female worker, She is the right to four months ten days Iddah leave.

Hajj Leave Under Saudi Labor Law

If a worker is going for performing Hajj, He is entitled to 10 days paid leave. An employee can perform Hajj only once in 5 years with the same sponsor. The employee needs to complete Two years with the same Sponsor to aware this advantage.

Marriage Leave Under Saudi Labor Law

Under Saudi Labor Law, an employee can entitle to five days paid leave for his wedding, Once in his duration with the sponsor. Suppose if he applies for 14 days marriage leave. Five days will deduct from marriage leave and rest of the days from annual vacations.

Maternity Leave Under Saudi Labor Law

A female employee is entitled to Ten weeks leave in of case of delivery of child as per the Article 151 to 156 of the Saudi Labor Law. Four weeks leave before the birth date, four weeks for maternity leave and six weeks leave after delivery of the baby. All the vacation is fully paid. Probably the birth date shall be fixed by the Doctor in written statement report.

Sponsor Unable to Terminate Her

The company cannot terminate her or stop her from the payroll of the company. She can also apply for her annual leave it depends and applies for one-month unpaid leave, After ten weeks of leaves. The sponsor should provide her extra rest of one-hour compare to other to feed her baby.

Full, Half, Unpaid Leave

These leaves may Fully be paid, Half Paid or Unpaid is defined of the duration of the job or worked with employer quota as below.
Fully Paid, Worked three years or More
Half Paid, Worked One year or More
Unpaid, Worked Less than One Year.

To attend to new-born child male employees can also avail of one day paid vacation.

Eid-Ul-Fitr & Eid-Ul-Adha Under Saudi Labor Law

In the Article 112 of the Saudi Labor Law, all the employee are permitted to have four days paid holidays, from Last day of Ramadan for Eid-ul-Fitr and from 9th of Zil Hajj for Eid-ul-Adha another four days paid leaves.

Saudi National Day

In Each Year of every 23rd of Sep is celebrated Saudi Arabia National Day in KSA. All the employee's Govt or non-Govt are granted one day holiday in the Saudi Arabia.

Important Note for a worker in Domestic:

Those employees who are domestic worker are excluded from the vacations mentioned above, Drivers, Household, and sponsored by individual Saudis to work at home. Those employees are entitled one month paid vacations for two years and one day for every week.
