Conditions to transfer sponsorship without Kafeel permission

  1. Upon arrival to Saudi Arabia if the employer/Kafeel didn't provide pick up service from Airport and any condition missing Kafeel and unable to contact him then employee/worker can report transferring without Kafeel permission. 
  2. As per Saudi Law, the employer must provide the accommodation with bathroom to their employees upon arrival. If the employer is violating the law by not providing the accommodations and the scenario with no improvements up to 15 days then the employee is entitled to file the complaint and transfer the sponsorship to another company/Kafeel/Employer. 
  3. No issuance of Iqama, no renewal of Iqama after expiry date or Health insurance. 
  4. In any condition, if the salary is regularly delaying and delay is for 3 months or more.
  5.  In case the current Kafeel have no work and allowing workers to work with anyone else without written contract. 
  6. Transferring workers to work under other Saudi relative or non-relative which is violating Saudi labor law. 
  7. Kafeel in the red category not following the law and Saudization. 
  8. Safety first, the any dangerous work without full PPE and causing health problems then the transfer will be accepting by Ministry of labor without current sponsor approval. 
  9. No action upon request of workers or any legit complaint from workers.
  10. False complaints of employers against employees such as false absent report or false run away report known Kharoob. 
  11. Any official complaint from workers to the ministry and no attendance from employers. 
  12. In any, a condition employers/Kafeel is out of the country for prolonged period and no salary.
  13. Kafeel death or Kafeel in jail and no salary up to 3 months. 
Transfering to another sponsor will process 15 days or exceeding 15 days to get workers probation period and acceptance. Upon transfer request, the new Kafeel must pay all the transferring fee and related cost. And arrange the requirements to the worker as per Saudi labor law.
