Employer Violation and Penalties Saudi Arabia


For those violating the rules of employee and employment to get punishment as per the rules. According to the Saudi Social Ministry of Labor and Social Development and which recently announces that the penalty for those companies who violate the rules and regulation of Saudi Labor law. And some of the important below penalties for the employer to violate the rules.

Violation of Returning of Passport

The Social Development and Saudi Labor Ministry sent warn notice to all Employers for the keeping of their expatriates employee’s, and as per Saudi newspaper, Ministry of Labor issued a warning to return all the passports to their expat employees.

Saudi, Labor Ministry decided to penalize with SAR 2000/ on those all companies, employers, Sponsor and Kafeels who keep their expat employees passport.

Unable to Provide Contract Copy

The Saudi Labor of Ministry recently circulate a warning notice to the sponsor, employer or companies to punish with the amount of  SAR 5000/- for unable to provide the contract copy to their employees.

Work Within Official weekend

If the employer forces their worker to work within holiday or officially week without payment then penalty imposing up to SAR 100,000 against the violator.

Work Another Job

If a company force his employees to work another work which was not part of his contract will receive the punishments penalty of  SAR 15000 business or establishment owner.

Ask Worker to Pay Expenses

According to Saudi law if a sponsor asks his employees to pay the costs which sponsor has to bear will also penalty him with SAR 15000/-

Working with Extra Hours

The company to get punishment for the violation collaboration with extra hours in not giving overtime payment to their employees will face the punishment of SAR 10,000.

Delay of the Salaries

Due to no pay or unable to continue salaries to the workers the company penalty is 3000 SAR.

Unlicensed Recruitment Offices

A company with unauthorized recruitment office penalty up to SAR 20,000

Penalty for Selling Visas

If A company is selling visas to expatriates then the penalty up to SAR 50,000 and For employing an expat employee without a license then the sentence of  SAR 45,000 to impose against the seller.

Malicious Absconding Reports

The Sponsor penalty up to SAR 5000/- for "proven" cases of malicious absconding reports.

Violation of Safety Regulations

If a sponsor or employer is caught forcing employees to work in inclement weather, these rules apply in summer's season of not working from 12:00 to 03:00 Pm or the sponsor to disregards safety and health standards regulations. In this case, the company fines against violator are SAR 25,000. 

Employing of Expat work on Saudi Place

Nobody will be allowed to recruit an expat a job restricted to the Saudi citizens the violator to get punishment. A warning notice issued to all employer find the violation of rule punishment fine with SAR 20,000/-

No Records for the Employee

If a company does not keep records and files of workers then can be fined for SAR 5,000
